ONLINE CONTRACT
Lauren Giuffré, Photographer Portrait Agreement + Policies.
This agreement contains the entire understanding between Lauren Giuffré, Photographer and the named client for the purpose of a photography session. Please read through the following information. By choosing “I Agree” you are agreeing to the terms and conditions of Lauren Giuffré, Photographer.
TERMS + CONDITIONS
[A] SESSION FEES
Client agrees to pay photographer a $300.00 retainer at time of booking to secure their appointment day and time. This is a nonrefundable retainer fee that goes toward your session. Retainer is payable via cash or check. The session fee covers the time and talent of the photographer, basic retouching and creative editing of images, as determined by the photographer. Additional editing is available at an additional expense to be determined by photographer. Final edit images with print release are included in the session fee. Prints and products are available for purchase. The charges in this Agreement are based on the photographer’s Standard Price List. This price list is adjusted periodically and future session fees and orders will be charged at the prices in effect at the time when the session is booked. There is no guarantee to the number of images presented from a session. Many factors contribute to this, including the cooperation of the client and individuals present at the session.
[B] LOCATION COSTS AND FEES
Session fee covers travel (for on location sessions only) within 30 miles of 83706. Any location outside of these limits will be subject to an additional charge agreed upon by client and photographer. Any costs or fees associated with the location the client has chosen for their session, the client will be responsible for those fees.
[C] CANCELLATION, POSTPONEMENT, LATE ARRIVALS AND RESHOOTS
Client acknowledges that in the event of a cancellation or postponement of the session, expenses or financial loss may occur. Client agrees to notify photographer of a postponement or cancellation at least 48 hours before scheduled session. If client fails to provide adequate notice, client agrees to forego their deposit to cover expenses that the photographer has incurred relating to the session. Postponements due to inclement weather will not incur a fee or lost deposit. Late arrivals will have amount of time late deducted from the total time allotted for the session. Reshoots are determined at the discretion of the photographer. Reshoots and refunds will not be given for not following the recommendations of the photographer including but not limited to poor clothing choices, hair, makeup or weather related issues and photographer reserves the right to cancel the session without the requirement of a deposit refund. Photographer reserves the right to reschedule due to weather, equipment malfunction, illness or other circumstances beyond their control.
[D] ARCHIVE
All images will be deleted from photographer’s hard drive after six (6) months with the exception of any images used for promotional purposes to be determined by photographer at photographer’s sole discretion. Galleries may also be deleted at this time. There is a $25 fee to extend the gallery past this time for an additional six (6) months. Photographer is not responsible for loss or damage to the digital files due to circumstances beyond photographer’s control.
[E] PAYMENT
All payments are due in full at time of session. Returned checks will incur a fee $30.00.
[F] MODEL RELEASE
I hereby give to Lauren Giuffré, Photographer the absolute and irrevocable right and permission with respect to the photographs that she has taken of myself and/or my minor child in which he/she may be included with others:
a) To copyright the same in the photographer’s name or any other name that she may select; b) To use, reuse, publish and republish the same in whole or in part, separately or in conjunction with other photographs, in any medium now or hereafter known, and for any purpose whatsoever, including but not limited to, publicity, web content, promotion, advertising and trade.
I hereby release and discharge photographer from all and any claims and demands ensuing from or in connection with the use of the photographs, including any and all claims for libel and invasion of privacy.
[G] LIMIT OF LIABILITY
In the unlikely event that the photographer cannot perform this Agreement due to a medical or natural emergency, or other cause beyond the control of the photographer, then the photographer shall return the deposit to the client but shall have no further liability with respect to the Agreement. This limitation on liability shall also apply in the event that photographic materials are damaged in processing, lost through camera malfunction, or otherwise lost or damaged in processing without the fault on the part of the photographer. Photographer is not responsible for any injuries inflicted upon any participating parties. Client(s) will be responsible for their children and for themselves and release photographer from any claims against their person or their business.
[H] COPYRIGHT + PENALTY
Lauren Giuffré, Photographer retains all copyrights to all images created during client’s session. A print release is included with session fee and may be used to print portraits for personal use. The print release does not allow publication of your portraits (i.e. entering in contests), selling or altering of your images without the photographer’s written permission. It is illegal for anyone to copy, rightclick, save to harddrive, screen shots, scan, alter or otherwise steal any image created by Lauren Giuffré, Photographer during a client’s photo session. This applies to “sneak peek” images, images posted on a blog, Facebook or other social media outlets. The client understands that this is punishable by law. Please note, the photographer works hard to create images that represent the client and their families while keeping in line with her artistic vision and creativity and wants to keep control over the final look of client’s images. Scanned, altered, or incorrectly saved images can damage the reputation of the photographer by distorting and devaluing the image quality. The photographer reserves the right to artistically interpret what she sees and in what ways to photograph a scene. This may mean that some shots are color, some black + white. Images presented to the client are the only images available. Please link back to my Blog/Website/Facebook/Instagram page if sharing any images on your own pages. Please respect the work of the photographer and avoid printing at places not known for photofinishing (i.e, RiteAid, Walgreens, etc).
[I] COOPERATION + PHYSICAL LIABILITY
All parties agree to positive cooperation and communication for the best possible result for the session. Photographer is not responsible for missed images due to any individual’s failure to appear or cooperate during the session. If there is any threat to the photographer or their equipment by any subject, the photographer reserves the right to end coverage immediately with no further liability to finish the session, with no refunds given. Additionally, the client is responsible for their own conduct and the conduct of all participants in the session. Any damage to equipment caused by the client are the sole financial responsibility of the client. Client agrees to hold the photographer harmless for any injuries or damages sustained preceding, during, and immediately following the session.
[J] ILLNESS + CORONAVIRUS DISCLOSURE - ASSUMPTION OF RISK AND LIABILITY
The client and Lauren Giuffré, Photographer do hereby understand and assume any and all risk of exposure to illness associated with participation in the session and agree to waive any and all legal claims against the other, to include, but not limited to, wrongful death and/or economic loss suffered as a result of any illness resulting from participation in the session. The client and Lauren Giuffré, Photographer do hereby agree to disclose any symptoms of illness or risk factors reasonably known or for which should be reasonably known to increase the likelihood of contracting or exacerbating any illness by any participants of the session. Failure to do so by the client and/or photographer to make necessary disclosures under this clause shall render the assumption of risk and waiver under this clause null and void.
[K] SEVERABILITY
If any provision of this Agreement is held to be invalid or unenforceable under the law, the validity of this Agreement as a whole shall not be affected, and the other provisions of the Agreement shall remain in full force and effect. Any modifications of this Agreement must be in writing and signed by both parties. This Agreement shall be governed by the laws of the State of Idaho.
